Navigating Florida Roof Insurance Claims: A Homeowner’s Resource Guide

Serving Fort Myers, Cape Coral, Sanibel, Naples, Punta Gorda, FL and surrounding areas

What All Florida Homeowners Really Need to Know

Filing a roof damage claim in Florida can be one of the most stressful experiences a homeowner faces. Between severe weather events and rapidly changing state laws, the property insurance landscape is constantly shifting.

At PRG Roofing & Construction Company we believe an informed homeowner is an empowered homeowner. We created this resource page to help you understand current Florida insurance rules, strict filing deadlines, and exactly how our team supports you through the documentation and repair process.

1. The Strict Deadlines for Filing Your Claim

Florida lawmakers have significantly tightened the window homeowners have to report storm damage. Missing these deadlines gives your insurance company the legal right to deny your claim entirely.

  • The 1-Year Initial Claim Deadline: Under current Florida law, you have exactly one year from the date of loss to file your initial property insurance claim. This is a major reduction from the previous two-year window. The clock starts on the day the storm hits, not the day you discover the leak.

  • The 18-Month Supplemental Claim Deadline: If hidden damage is discovered later (such as trapped moisture or structural decay not visible in the first inspection), you have 18 months from the original date of loss to file a supplemental claim.

  • Insurer Deadlines: The rules apply to insurance companies, too. Once you file, your insurer is required to acknowledge receipt within 14 days, and they generally have 60 days to investigate and either pay, deny, or partially pay your claim.

How PRG Roofing & Construction Makes a Difference:

We respond rapidly after severe weather. We perform thorough, immediate inspections to ensure you don’t miss your 1-year filing window. Because we know that insurers require proof, we meticulously document the exact scope of the damage with timestamped photos, giving you the immediate evidence you need to file your claim on time.

2. The End of the “25% Rule” – Repair vs. Replacement

Historically, Florida had a rigid “25% Rule.” If a storm damaged 25% or more of your roof within a 12-month period, the building code mandated a full roof replacement.

However, recent legislation and the Florida Building Code update (effective December 31, 2023) eliminated this mandatory replacement rule. Today, localized repairs on code-compliant roofs are legally allowed.

The Catch: While a patch job might be legal, it isn’t always smart. Insurance carriers may view an older, patched roof as an unacceptable risk and choose to drop your coverage or significantly raise your premiums.

How PRG Roofing & Construction Makes a Difference:

We provide honest, structural assessments. Instead of just pushing for a full replacement or doing a cheap patch that makes your home uninsurable, we evaluate the big picture. We provide you with the unvarnished truth about whether a repair will compromise the roof’s structural integrity or put your future insurance eligibility at risk, helping you make the most financially sound decision.

3. The Ban on Assignment of Benefits (AOB)

In the past, many Florida roofing contractors used an “Assignment of Benefits” (AOB) contract. This document transferred your insurance claim rights entirely over to the contractor, allowing them to make decisions, file lawsuits, and collect checks without your involvement.

In December 2022, Florida passed property insurance reform (Senate Bill 2-A) that effectively banned Assignment of Benefits for property insurance claims.

Today, the power remains in your hands. You maintain control of your claim, but it also means the payment responsibilities shift: you must coordinate directly with your insurer for reimbursement.

How PRG Roofing & Construction Makes a Difference:

We never use predatory contracts, and we fully support your right to control your claim. Because you have to negotiate your reimbursement directly, we act as your technical support system. We provide highly detailed, transparent estimates and comprehensive documentation upfront. We supply exactly what your insurance adjuster needs to see—code requirements, material specifications, and structural data—making it incredibly easy for you to file your claim and secure your proper payout.

4. The PRG Standard: Built for the Claim Process

We are roofers, not public adjusters or attorneys, but we know exactly what a successful roof claim requires from a construction standpoint. When you partner with PRG Roofing & Construction Inc., you receive:

  • Unarguable Photo Evidence: A complete photographic record of wind uplift damage, missing shingles/tiles, and compromised underlayment.

  • Code-Compliant Estimates: Line-item estimates that perfectly align with current Florida Building Code wind zone requirements, making it harder for insurers to lowball the repair costs.

  • Adjuster Collaboration: We are happy to meet your insurance adjuster on-site during their inspection to point out hard-to-see structural damage and ensure nothing is overlooked.
